Upon acceptance of this Service Agreement (the “Agreement”) by DO YOU UNIVERSITY, INC (“DYU”), and the undersigned client (“CLIENT”) this Agreement constitutes a binding agreement between DYU and CLIENT.

SERVICES PROVIDED AT WILL

CLIENT understands and agrees that DYU has the right to terminate the provision of admissions consulting services (“Consulting Services”) at any time, with or without reason. In such event a pro-rated refund will be issued to you within thirty (30) days, if necessary.

NO GUARANTEE OF RESULTS!

DYU makes no guarantee, express or implied, with respect to the likelihood of CLIENT’S admission or acceptance to any college or university to which CLIENT submits an application for admission.

REFUND POLICY

If CLIENT purchases CONSULTING SERVICES on an hourly basis, CLIENT understands that DYU will provide CLIENT an itemized statement of services rendered (“STATEMENT”) every time that CONSULTING SERVICES for which CLIENT pays have been completely tendered or delivered for the CLIENT’S benefit. CLIENT understands and agrees that DYU will, during and only during the thirty (30) calendar days after a Statement has been delivered to CLIENT, at CLIENT’S request, issue a pro-rated or 100% refund of the CLIENT’S payment for those and only those CONSULTING SERVICES covered by that Statement, subject to the following limitation: when CLIENT makes any purchase of CONSULTING SERVICES, CLIENT thereby waives any and all rights that CLIENT would otherwise have had to a refund for those Services which CLIENT had previously paid for and received. If CLIENT purchases a Comprehensive Package, DYU, will notify CLIENT when three hours of Services have been rendered, upon which notification CLIENT will have the option to either receive a refund of CLIENT’S payment or continue to receive said CONSULTING SERVICES. If CLIENT chooses to continue to receive CONSULTING SERVICES, CLIENT will not be eligible for a refund except in the case that DYU becomes unable to render requested support relevant to CLIENT’S applications.

RETURNED CHECK POLICY

CLIENT agrees to pay a service fee to DYU for any check written by CLIENT to DYU that is not honored by CLIENT’S bank for any reason. The service fee will be $55.00 for a paper check, and $35.00 for an electronic check. Any such service fee will be in addition to and payable to DYU without respect to any fees charged to CLIENT by CLIENT’S bank.

REASONABLE LEGAL FEES!

CLIENT agrees that in any legal action arising out of this Agreement, the prevailing party shall be entitled to recover the reasonable attorney’s fees incurred by such party in the proceeding.

PERSONAL JURISDICTION

CLIENT agrees that this Agreement shall be governed by laws of the State of Illinois, and any litigation arising out of this Agreement shall be commenced in Chicago (Cook County), Illinois. To adjudicate any such litigation, CLIENT consents to the personal jurisdiction of the Illinois courts even if CLIENT’S residence is in another state or country and CLIENT would not otherwise be subject to jurisdiction of the courts in Chicago (Cook County), Illinois.

ACCEPTANCE OF ALL TERMS

I hereby accept all of the above covenants, policies, and stipulations with respect to the CONSULTING SERVICES as binding and effective from and after the date of my signing this Agreement.
